Does 'Ryan' put 'Tasini' on the road to reversal? Authors' victory in photocopy distribution case causes some to question viability of 'Tasini.'(Intellectual Property)
Article Abstract:
Publishers and database compilers are enthusiastic about the new electronic database distribution opportunities and the additional income they generate, and both researchers and the public as a whole benefit as well. Freelance authors, however, have been reluctant to embrace the electronic redistribution concept, and this is mainly because of the database compilers' refusal to pay them licensing royalties. Tasini v. New York Times Co. and Ryan v. Carl Corp., seminal cases in the area, are discussed.

ISP immunity gives little recourse for the defamed; libel victims are now more vulnerable, particularly when online authors are hard to find
Article Abstract:
Internet service providers' (ISP) immunity to libel suits reflects the view that they should not have to monitor the content of their customers, but makes it hard for libel victims to obtain relief in those emergency situations which happen so often on the Internet. While much of the Communications Decency Act has been overturned, section 509(c)(1), the ISP safe harbor provision, has not. Various federal court rulings have interpreted it to allow a broad immunity in favor of ISPs.

Ethics now a game of appearances: authors say overregulation has expanded loopholes
Article Abstract:
After Watergate, additional rules and regulations were put in place to discourage ethical digressions in politics, government, and society at large. Unfortunately, the purchase and sales of influence has become more, not less, prevalent. Observance of the letter of the laws dealing with ethics, while trampling on the spirit of these laws, has become a common occurrence.
