EEOC issues guidance on psychiatric disabilities under employment provisions of ADA

Article Abstract:

The US Equal Employment Opportunity Commission has released comprehensive guidance for employers on how to address issues of employee psychiatric disabilities under the Americans with Disabilities Act. The report defines how mental impairments can qualify as disabilities, what types of reasonable accommodations may be warranted, and how an employer may investigate to determine whether a mental disability is present. Other issues addressed include confidentiality, risk of harm to others, and what limitations qualify as substantial.

Courts continue to limit scope of ADA

Article Abstract:

The US Supreme Court in Sutton v. United Air Lines, Inc. held that corrective measures which may be taken must be considered when courts determine what qualifies as a disability under the Americans with Disabilities Act (ADA). Measures which may mitigate physical or mental disabilities such as eyeglasses or medication are relevant to the availability of ADA relief.
