EU trademark systems create new quandaries; WIPO's Madrid Protocol amd Community Trade Marks Office offer competing filing regimes
Article Abstract:
Trademark rights are one of the areas of European Union law in the most flux and 1996 saw the start of the Madrid Protocol and the European Union Community Trade Marks Office, two related trademark registration procedures. The Protocol answered many of the objections to the earlier Madrid Agreement, providing a mechanism for protecting marks in many countries with an application to a central filing office. The Protocol seems to be the multinational filing system so badly needed in a global economy.
