Ethical abuse of technicalities: a comparison of prospective and retrospective legal ethics
Article Abstract:
Some ethicists claim that prospective legal ethics differs from retrospective legal ethics. This view holds that ethical analysis of advice to clients varies according to whether the analysis is done before or after the advised action is accomplished. Analysis of the Bronston v. US question of whether a lawyer can ethically advise a client to answer a question evasively yet not perjuriously suggests no real difference between the prospective and retrospective cases.
