Fencing the oceans: a rights-based approach to privatizing fisheries
Article Abstract:
A rights-based fisheries management program has been proposed by governments as an alternative to command-and-control methods which have proven ineffective in preventing the depletion of fish stocks. In contrast to regulatory methods which are concerned with allowable catch, season, and vessel size, the right-based method establishes private ownership of fish stocks. Fisheries would be divided into regions and be assigned to specific fishers who would be placed in charge of maintaining the population of fish stocks in the area.

Subsidies are not property rights
Article Abstract:
Federal subsidies could be elevated to the level of constitutional rights under the Omnibus Property Rights Act of 1995, S. 605. Subsidies for resources, such as water and grazing land, are already a burden for taxpayers. The Omnibus Property Rights Act of 1995, when loosely interpreted by property owners, grants them the right to sue if the government tries to change the rates or access to resources. Regulatory reform may be called for, in light of these issues.

Article Abstract:
The authors discuss the US Supreme Court's decision in Phillips v. Washington Legal Foundation, in which they ruled that interest earned in IOLTA programs is the property of clients but did not rule on whether it constituted a taking and thus required just compensation.
