California's authority to regulate mobile source greenhouse gas emissions
Article Abstract:
California recently passed Assembly Bill 1493 to regulate motor vehicle emissions. Although the federal Corporate Average Fuel Economy statute would preempt any attempt to mandate a state miles-per-gallon standard, California can still enact emissions standards. It also may enact legislation designed to encourage consumers to buy low-emissions cars.

Arguments that the regulation of corporate corruption has become so extreme that it criminalizes normal economic activity are given. The fair notice requirements of the due process clause are given as the prime argument. The Justice Department's recently written corporate prosecution guidelines need to be rewritten.
