Hidden opportunities and dangers in International Trade Commission Section 337 proceedings
Article Abstract:
There are special advantages and dangers of filing unfair competition suits with the International Trade Commission (ITC) under section 337 of the Customs Duties Code. Such cases can be used in parallel with patent infringement suits to provide more immediate relief by stopping importation of foreign products at issue. Dangers result from initial discovery proceedings and possible revelation of the patent suit trial strategy. Another danger comes from the power of the ITC to deny action on grounds of public interest.

Remarks before the Intellectual Property section of the A.B.A
Article Abstract:
The Patent and Trademark Office has set new goals with the Clinton administration. Commerce Sec Ron Brown gave a mission statement with three parts, including legal administration, policy and advice on intellectual property. Special activities will help with the Japan Trade Framework Agreement and the proposed information superhighway. Special focus will also go to patent harmonization, system automation and policy mechanisms.
