High court hears case on state power over banks; at issue is whether states can prohibit nationally chartered banks from selling insurance
Article Abstract:
The US Supreme Court on Jan 16 heard arguments in Barnett Bank of Marion County NA v Gallagher, concerning the rights of states to restrict exercise of a federal right. The case involves a federally chartered bank seeking to sell insurance despite state laws to the contrary. Ordinarily federal law trumps state law, but the 1945 McCarran-Ferguson Act reserves to states the right to regulate insurance except for insurance-specific acts of Congress. The Court must decide to what degree the laws involved address insurance.

London court reigns as an international forum: parties in cross-border disputes welcome the Commercial Court's expertise, neutrality and speed

London's Commercial Court has gained international popularity as the forum of choice for litigating business matters because it blends the convenience of dispute resolution with the security of state-backed courts. Many parties outside Britain stipulate use of the court to resolve any differences, in part because it has such remedies as the Mareva injunction, which freezes the British or even worldwide assets of a defendant. How and when litigants can use the Commercial Court is considered at length.

Where business is king: London's Commercial Court hears international clashes
Article Abstract:
London's Commercial Court has become a popular international forum thanks to its professional approach and highly competent judges experienced in commercial law. Considered prompt and effective, it deals largely with non-British litigants, and most cases involve insurance, shipping, international sales, and banking. Lloyds of London litigation, the largest block of civil litigation ever in the UK, currently clogs its docket but the court is learning to manage it. It heard its first case in 1895.
