Impact of the Americans with Disabilities Act on job evaluation
Article Abstract:
Human resources personnel and management engaged in the process of job evaluation must ensure that tasks and responsibilities not done by a employee due to Americans with Disabilities Act (ADA) "reasonable accommodations" do not affect the job rating. If exclusion of tasks from the job evaluation resulted in a lower job rating and a corresponding lower compensation level, the employer could be subject to discrimination charges. Employers can address this problem through proper distribution of marginal tasks not central to the job.

Alexander v. Gardner-Denver: staggered but still standing
Article Abstract:
The Supreme Court, in Wright v. Universal Maritime Service Corp., ruled that the waiver of an employee's right to seek judicial relief for alleged employment discrimination under the Americans with Disabilities Act must be clear and unmistakable to be valid. The Court's holding thus weakened its 1974 ruling in Alexander v. Gardner-Denver Co. which limited the power of collective bargaining agreements to require union members to submit statutory civil rights claims to mandatory arbitration.

Article Abstract:
The authors discuss the place of seniority in making employee-related decisions and reassignment as a reasonable accommodation under the Americans with Disabilities Act in non-union settings. A related case, US Airways, Inc. v. Barnett, slated to be heard by the Supreme Court during its 2001-2002 term, is described.
