Resolving consumer disputes: Due Process Protocol protects consumer rights

Article Abstract:

The American Arbitration Assn adopted the Consumer Due Process Protocol in May 1998. The protocol protects rights of consumers who are bound by contract to participate in ADR. The protocol ensures access to ADR information, representation, neutrality of arbitrators and mediators, and adequate notice. Questions remaining include whether arbitration should be optional or mandatory and how to determine limitation of damages.

Bilateral investment treaties and arbitration

Article Abstract:

Parties to bilateral investment treaties should understand how the terms of the treaties affect possible future arbitration. Some countries do not allow arbitration. If arbitration is allowed, specific terms of the treaty will affect arbitration methods. Terms such as party and investor need to be carefully defined. Arbitration options and the jurisdiction that will enforce decisions also must be identified.
