Labor-management cooperation: a critical view
Article Abstract:
Labor-management cooperation and interest-based bargaining are receiving increased attention as more effective ways than traditional collective bargaining for dealing with the rapidly shifting economy. Interest-based bargaining can be useful for dealing with certain issues such as seniority, productivity and maybe health insurance, but does not lend itself readily to dealing with the economic parts of the collective bargaining agreement. Labor-management cooperation is more likely to take place in a more secure economy where workers do not have immediate concerns about layoffs.

Age discrimination in employment: the over qualified older worker
Article Abstract:
Rejecting older job applicants because they are overqualified will not pass muster under the Age Discrimination in Employment Act of 1967 (ADEA). Proof of such discrimination can be established under the theories of disparate treatment or the more lenient disparate impact. After the plaintiff has laid out a prima facie case, the employer must give a legitimate justification for the alleged discrimination. The ADEA has some exceptions, such as when age is a 'bona fide occupational qualification.' Remedies resemble those available under the Equal Pay Act.

Labor and management response to total quality management
Article Abstract:
Many managers have adopted total quality management (TQM) during the past decade. The main reason for this trend is the declining competitiveness of American companies. Its chief characteristic is employee involvement. Management's main fear is the loss of its decision-making power. Unions fear that quality circles will supplant them. Employee grievances, an area traditionally handled by unions, have declined in firms with participative programs. On the other hand, quality circles in union firms seem to enjoy a much longer life.
