Article Abstract:
Attorneys are concerned about the unauthorized practice of law (UPL) as more automated legal forms appear on the Internet and legal questions are asked in chat rooms or e-mail discussion lists. The dangers of UPL are threefold and include conflict of interest by unknowingly jeopardizing the interests of an existing client in answering a stranger's question, practicing law outside the jurisdiction where one is licensed to practice, and opening oneself up to various professional liability charges by practicing law online.

Jurisdictional battles are likely in Internet suits, and an understanding of the Internet in its various forms, Web sites, discussion groups, private e-mail messages and e-mail discussion lists is necessary to analyze whether the defendants have purposefully availed themselves of a state's residents or resources. Such evidence goes to personal jurisdiction's 'minimum contacts' test, and electronic commerce clearly involves personal jurisdiction.

High-tech issues to watch in 1999
Article Abstract:
The end of 1998 leaves computer industry lawyers with a number of high-technology issues to watch in 1999. These include case law on the digital republication of printed works, suits challenging the Rio music player, which makes it easier to copy musical compositions and send them over the Internet, and also the continuing antitrust suit against the Microsoft Corp.
