Line-item veto: who'll vote how; court-watchers guess which justices will find standing and merit in law
Article Abstract:
The Paula Jones v. Clinton case may have garnered all the 1997 publicity, but Raines v. Byrd, a constitutional challenge to the Line Item Veto Act of 1996, could actually be the key political case of the US Supreme Court's 1996-97 term, with implications for the constitutional balance of powers far greater than the Jones case. Threshold issues are whether legislators who challenged the act have standing and whether the case is ripe for the courts, even though the president has not yet exercised authority under the act. The act permits the president to cancel three kinds of budget items.

Court takes more cases as the term draws near
Article Abstract:
The US Supreme Court granted certiorari on Sept 27 to several constitutional challenges filed over the summer. Among those accepted are a challenge to the secretary of commerce for refusing to make statistical adjustments to the 1990 census, a separation-of-powers argument concerning the military death penalty, a copyright challenge, and significant banking and patent cases. It will also review challenges brought by former Los Angeles police officers Stacey Koon and Laurence Powell, concerning sentencing guidelines.

Race tops the docket: promoting diversity may not justify the layoff of a white N.J. teacher
Article Abstract:
The Supreme Court in its 1997-98 term will tackle the question of the extent to which affirmative action goals and diversity considerations can play a role in layoff decisions. In stark contrast to the momentum which has existed throughout the judiciary since the sixties, the 1990's Supreme Court stands poised to reverse the direction decisions have taken in the past and possibly disallow the use of race even for corrective purposes.
