Civil litigator C Barry Montgomery won a major 1995 case for Turner Construction with tactics that presented his own case during cross- examinations of the opposing witnesses. He strives to present his case early on, before jurors have decided against him, and uses mock juries to resolve tricky questions and determine the best jury type. In this case he chose a theme portraying the plaintiffs as owners suing their workers, his client. In keeping with that he assembled a classic plaintiff's jury of trade workers and employees. He cut his own presentation drastically.

Bad-faith insurance litigator William M Shernoff won an $86.7 million verdict for American Samoa's government by helping jurors sympathize with the plaintiff and making the most of poor defense witness choices. He sat in on many depositions but took no active role, preferring to study witnesses and decide how to attack them and reveal their ingrained arrogance. He told his side's story chronologically and in simple form, negating defense efforts to emphasize sophistication and complexity.
