Marks hard to break in '96 games; infringers will face high hurdles under sponsor-protection plan

Article Abstract:

The sponsors of the 1996 Atlanta Olympic Games and those licensed to supply official merchandise will probably have to file suit to enjoin counterfeited and unlicensed merchandise, but the organizers of the Atlanta games have carefully built up a system to protect and enforce the exclusive marketing rights of these people. The agencies are, of course, the United States Olympic Committee (USOC), its marketing joint venture the Atlanta Centennial Olympic Properties (ACOP) and the Atlanta Committee for the Olympic Games (ACOG).

Starting to register: moving-image marks; the trend toward registering non-traditional marks has extended to moving images on various media

Article Abstract:

Trademark registration is developing to include the protection of nontraditional marks and many unique visual sequences. This is particularly important in film and television and the expanding areas of multimedia production and online distribution. There are only a handful of registrations to protect moving images. The Patent and Trademark Office generally permits non-traditional marks to be registered if they are unique or have obtained secondary meaning. Copyright law also protects moving-image design marks.

Registering 3-D marks helps owner; if a configuration is registered, burden of proof is on infringers

Article Abstract:

Federally registering a product or package configuration brings many benefits but too few companies take advantage of the process. Trademark registrations reduce the burden of protecting a product from infringement, establish a nationwide claim, aid in getting overseas registration, and let the owner use US Customs to block infringing products from coming into the US. A configuration should be distinctive, nonfunctional, and actively used by the owner to facilitate registration.
