May a lawyer deal away right to practice? Promise never to take on suits against NYMEX produces conflicting views
Article Abstract:
The settlment agreement sent to lawyer Scott M. Brenner by the New York Mercantile Exchange contained a demand for a promise that he promise not to sue the agency again, and Brenner agreed to this restriction because of a duty to his client, a former trader, to get the best settlement possible. The Commodity Futures Trading Commission is investigating because this agreement may have violated the rules of professional responsibility, although New York and other states have found agreements to restrict practice legal.

Ethics code is integral in practice
Article Abstract:
Law firm ethics policies require a great deal of planning. General policies can be enshrined in writing, while a professional standards committee can provide an ongoing forum for addressing specific issues. Key ethical issues include personnel matters such as nepotism and fraternization, aspects of the attorney-client relationship and auditing and confidentiality of the firm's finances.

Legal ethics: practice what isn't preached
Article Abstract:
Lawyers must never forget that theirs is a profession with the power over life or death, freedom or imprisonment and that ethics is all-important in a profession with such powers. The importance of ethics is not being inculcated in law students today. Lawyers must speak out on the importance of ethics in law school curricula and in legal practice.
