New DOL proposed regulations concerning procedures applicable to all ERISA plans
Article Abstract:
The US Labor Dept (DOL) issued proposed regulations regarding ERISA plan administrators' disclosures to employees in response to the Clinton Administration's Nov 1997 report, the Consumer Bill of Rights and Responsibilities. Significant enough changes to the rules guiding health care plan claims procedures would result in 29 Code of Federal Regulations section 2560.503-1 being replaced. The proposed rules address availability and timing of claims with procedures to be governed by a standard of reasonableness. The DOL for the first time explicitly stated the unavailability of mandatory arbitration under ERISA.

IRS issues proposed regulations concerning plan administration with new technologies
Article Abstract:
The IRS issued proposed regulations in Dec 1998 addressing the administration of retirement plans which utilize paperless technologies. The regulations contain flexible standards regarding transmission of documentation,such as notices, using electronic media. IRS Notice 99-1 reaffirms the IRS's acceptance of paperless administration in transactions where other guidance or statutory provisions may apply.
