New offence of employing illegal immigrants takes effect
Article Abstract:
A UK law effective in 1997 makes it a crime to employ illegal aliens. However, employers who comply with the Asylum and Immigration Act's guidelines on pre-employment documentation checks will not be criminally liable. Liability for existing employees is similarly excluded from the law. Employers should avoid race-based employment discrimination by handling all applicants in the same manner. A list of the types of applicants' documents that employers should review and retain is included.

Foreign nationals working in the UK are governed by both UK and EC law, and may have to obtain work permits. EU member state or European Economic Area nationals are permitted to enter the UK to work and to move freely within it, but other foreign nationals may need permissions to enter, remain, and work in the UK. This latter group is subject to the Immigration Act 1971. The main provisions of the UK's Work Permit Scheme are also described.

Article Abstract:
Employing illegal aliens in the UK is against the law under the 1996 Asylum and Immigration Act, effective Jan 1, 1997. Employers will be able to defend themselves if they unknowingly hire illegals based on false documentation that appears to be legitimate. The maximum penalty for each infraction is 5,000 pounds sterling. Company officers also may be held liable under the Act. Employer guidance on the law will be issued by the Home Office.
