Online patent searching: a good news story, but not the whole story
Article Abstract:
A statistical survey based on patent searching from 1988-1994 reveals that manual searching using the US Patent and Trademark Office paper files yielded the highest number of good section 102 references. Online searching of the USPAT database yielded the second-most results, with manual searches of foreign art and inquiries made of Examiners yielding fewer results. The data suggests that the most effective strategy is not to search exhaustively through the one medium that yields the most results but is to employ multiple search types, both online and paper-based.

Improvements in patent licensing
Article Abstract:
An improvement clause should be part of a patent license when access to future developments in the patent is important. The grant-forward and the grant-back are the two types of improvement-granting clauses. Improvement rights can also be granted by the scope of coverage. Functional definitions need to be as clear as possible. It is, of course, difficult to place a monetary value on unknown future improvements, but the royalty rate should allow for these as much as possible. Restrictions on the usage and the timing of disclosure are other considerations.

Licensing technology: a financial look at the negotiational process
Article Abstract:
Licensing technology negotiations require ongoing financial analysis of the technological and business risks involved. The contracting parties must consider the amount of compensation proper for assuming these risks including royalty rates, as well as the need for exclusive or non-exclusive licenses. A financial approach can help with patent valuation and negotiating splits of license-adhering benefits.
