Our homes are not dumps: creating nuclear-free zones
Article Abstract:
The Mescalero Apache's referendum to develop a monitored retrievable storage (MRS) site for spent nuclear fuel is morally questionable in light of the US government's attempts to establish nuclear dumping sites among Native American tribes. Seventeen tribes considered accepting MRS on their lands, all but the Mescalero and 2 other tribes rejected it. The Mescalero first voted down accepting a MRS in Jan 1995 but a second vote in Mar 1995 passed under political pressure. The National Environmental Coalition of Native Americans is lobbying for Indian lands in the US and Canada to be declared nuclear free zones.

Down in the dumps: can states regulate out-of-state waste flow and survive the commerce clause?
Article Abstract:
States should be able to pass constitutionally valid legislation protecting aggressive waste reduction and management programs from unfair exploitation by other states. Since the Supreme Court has recognized the conservation of natural resources and reduction of solid waste disposal to be valid state interests, and has also ruled that state laws affecting commerce can meet a Commerce Clause challenge if the laws are applied without prejudice, states can pass laws protecting their citizens from the hazardous effects of other states' exploiting landfill space if the laws do not discriminate unfairly.

Article Abstract:
Noah Sachs arguments against the Mescalero Apache Tribe's monitored retrievable storage (MRS) project for spent nuclear fuel are not completely accurate. The project offered a proactive approach to resolve waste nuclear fuel storage in the face of the government's reluctance to fulfill its responsibility under the Nuclear Waste Policy Act of 1982. MRS would not have been exempt from any safety measures or procedures as Sachs claims. Nor would it be economically unsound to create a single, centralized facility instead of 72 smaller ones.
