Parents of young people in trouble
Article Abstract:
The 1991 Criminal Justice Act that punishes parents in England and Wales for the unlawful behavior of their children is promoting parental resentment rather than responsibility, as it had intended. The message communicated in the Act is negative, which makes parents feel they are being treated unfairly by the court. As a result, parents' relationships with their children tend to deteriorate further, mostly because the young people think they can deflect the responsibility for their actions on to the parents. Parents, in turn, resent the bind-over orders.

Harshest sentence is restititution
Article Abstract:
The OJ Simpson trial demonstrates the weaknesses of a criminal system based on punishment and indicates how a restitution-based system might be better. Harsh punishment mandates many protections for the accused, ones which are not available in the civil system and which make conviction much less likely. Further, the case shows that the strongest argument of restitution foes, that of the wealthy murderer, is just as problematic in the present system, which encourages a ferocious defense by expensive lawyers.

People talking about punishment
Article Abstract:
The public favors tougher sentencing policies; however, a misunderstanding among people about the leniency of sentencing seems to contribute to this opinion. Researchers used focus groups to assess attitudes about sentencing. They found that participants generally approved of the sentences that were actually handed down, except for serious crimes, which many felt should be severely punished. The public needs to be better educated about rehabilitative sentencing, probation, and sentencing practice.
