Please! A princess deserves a little privacy; Diana prevails in suit over health club photos. It may set precedent for non-royals, too
Article Abstract:
Princess Diana succeeded in her breach of contract and right of privacy suit against Bryce Taylor and Mirror Group Newspapers who respectively took and published photographs of her working out in Taylor's health club. Both defendants agree to give Diana the funds intended for Taylor, an injunction against using the photos was agreed upon and the originals and negatives were given to Diana's lawyers to be destroyed. This case signals a victory where privacy law is just developing and also the ability of royalty to participate in a lawsuit was confirmed.

'Pink Panther' strikes famous marks; Federal Court of Appeal makes Canada's concept of trademark confusion a bit more confusing

Canada's Federal Court of Appeal held in the 1998 ruling United Artists v. Pink Panther Beauty Corp., in which United Artists held that the beauty products' use of the 'Pink Panther' name infringed their famous mark, that theree was no logical connection between the opposing parties' goods and services. The Supreme Court of Canada has agreed to hear an appeal.

Too famous to trademark: Diana case proves point; court found use of her persona so widespread that it could not indicate a source of goods
Article Abstract:
A California court ruling in Cairns v. Franklin Mint Co. that the persona of Diana, Princess of Wales was too well-known to be protected as a trademark and thus allowing the plaintiff to continue using her name and image in the sale of commemorative items is discussed. The suit was brought by the executors of her estate.
