Article Abstract:
A review of recent cases presented in the industrial tribunals and the Employment Appeal Tribunal's (EAT) response in these cases helps summarize some of EAT's points of procedure. Only one application for extension of time is allowed to respondents to enter a notice of appearance. Industrial tribunals can use their discretion in deciding on a submission of 'no case to answer' as there is no widely applicable test. Another important procedural matter is that tribunals will place cost orders on appeals brought merely as delaying procedures. Solicitors and counsels involved in such appeals will also be penalized.

Article Abstract:
Employment law developments and points of procedure in the UK's Employment Appeal Tribunal (EAT) and industrial tribunals are surveyed. A number of cases concern tribunal and EAT jurisdictional matters or hearing procedures. Compromise agreements, ACAS conciliated settlements, time extension, private and preliminary hearings, postponement, industrial tribunal bias, extended and summary reasons, EAT costs, and reviews of EAT decisions are among the issues discussed.

Article Abstract:
The British Employment Triunal's workload contains, in large part, appeals from Industrial Tribunal decisions on procedural issues, and such cases often go on to the Court of Appeal. Included is the manner of settlement of an industrial tribunal breach of contract claim, of discovery, of general tribunal discretion and the power of a tribunal to dismiss a complaint. Significant cases on procedural matters are reviewed.
