The authors discuss the requirement in UK and US copyright law that words must be reduced to material form or fixated for the law to be applicable and argue that such form should not be necessary.

Reining in copyright law: is fair use the answer?
Article Abstract:
The United Kingdom has recognized a small number of specific exceptions to allow use of copyrighted works. An approach adopting a more general doctrine of 'fair use' would be more fair to users.
