Public library Internet limits spark litigation; in one case, adult library patrons mount a First Amendment challenge to a library's use of a filter restricting Internet access
Article Abstract:
Much case law has discussed whether the Communications Decency Act (CDA) is an unconstitutional restriction of free speech as well as users' First Amendment rights for unrestricted use of the Internet. Mainstream Loudoun v. Trustees of Loudoun County Public Library is one of the lawsuits challenging public libraries' responses to the Internet. The plaintiffs, representing adult citizens of the county, challenge the validity of a filter imposed by the library trustees on Internet access. The CDA and Loudoun deal only with censorship issues and do not challenge reasonable time, use and place restrictions imposed by libraries on Internet access.

Palestinian case skirts free-speech protection
Article Abstract:
Reno v. American-Arab Anti-Discrimination Committee, to be argued before the Supreme Court in Nov 1998, regards the right to prompt judicial review of a complaint asserting a First Amendment defense in response to the government's prosecution. The plaintiffs in Reno are immigrants and members of a PLO faction but under the INS interpretation of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 these immigrants are not entitled to prompt judicial review. Our democracy needs the court to protect these immigrants' rights.
