Recent decision may jeopardize joint defenses; magistrate judge disqualified all firms for insurers because of one's conflict of interest
Article Abstract:
A federal district court disqualification of attorneys for defendant insurance carriers in Essex Chemical Corp v. Hartford Accident & Indemnity Co. was motivated by concern that one of the law firms might have a conflict of interest that could have led to confidential information being improperly passed to other firms. This ruling had already influenced joint defense agreements, which may be used less by large corporations and their law firms if Essex is upheld on appeal.

Article Abstract:
An allergic reaction defense can be successful in avoiding strict liability in toxic tort cases. Establishing that the plaintiff's reaction is unusual and that the product produced no adverse reactions in testing will demonstrate that the manufacturer, suspecting no defect, was not compelled by any duty to warn.
