Reflections on the juvenile death penalty: contravention of precedent and public opinion
Article Abstract:
The issue of the constitutionality of the juvenile death penalty is still the subject of considerable debate in the US. The death penalty can be imposed on juveniles in 20 states. The Supreme Court's analysis of capital punishment has focused on the Eighth Amendment, under which cruel and unusual punishment is banned. As the law currently stands, the juvenile death penalty is constitutionally permissible, but it is clear that it has no impact on reducing violent juvenile crime.
