Second wind; tobacco battles shift back to trial courts after justices spare the industry from FDA regulation

Article Abstract:

The Supreme Court ruling in FDA v. Brown & Williamson spared the tobacco industry from having the agency oversee the nicotine content of cigarettes, although many juries are holding that industry guilty of a conspiracy to hide the truth about cigarettes and thus liable for smokers' injuries. Congressional Democrats now promise to resume the issue of expanding the FDA's domain.

Bridging the damages gap; job-bias plaintiff wants to put more teeth into punitives criteria

Article Abstract:

The courts are, eight years after the Civil Rights Act of 1991, split on a job discrimination victim's right to punitive damages. Kolstad v. American Dental Ass'n is on the US Supreme Court's Mar 1999 calendar and gives the high court the opportunity to rule on this issue. Kolstad claims she was turned down for a promotion by a supervisor who had made derogatory comments about women and that the position went to a less-qualified male colleague.
