Exposing fatal flaws: deposition is the time to find weaknesses in witnesses

Article Abstract:

Deposition time is the best opportunity for finding an expert witness's weak spots. Tips are provided for how to cross examine such witnesses, including general principles to follow. These include doing one's homework, asking why, not testing theory with the opponent's help and learning about the expert's reading and personal hero. Lawyers should also debrief themselves by making notes on the expert immediately after depositions.

Should you hide the flag? It can pay to reveal case strengths during depositions

Article Abstract:

Most cases settle before trial, so depositions are the only times lawyers have to demonstrate their talent and shape both sides' evaluations of the case. This can be a reason for trial lawyers not to keep their talent hidden until trial. This is what trial lawyers are doing when they give defendants their 'day in the life' videos early in discovery - showing how effective their evidence will be if the case gets to trial.
