Spotlight aimed at ephedra; ballplayer's death heightens scrutiny

Accusations that the dietary supplement ephedra causes heart attacks, strokes and seizures and led to the deaths of very young people are discussed. The ephedra controversy became high profile when the Baltimore Orioles pitcher, who was using the supplement to help him lose weight, collapsed and died during spring training workouts.

The National Law Journal's survey of the 100 largest verdicts for 2002 is given. Many defendants lost, as the list was almost 3.5 times larger than a year ago. The tobacco industry was the biggest loser, though, with the record-setting Bullock v. Philip Morris joining the many other suits the industry lost in the last few years

The wrestling match with ERISA goes on; pre-emption still an abyss after ruling

The difficulty of interpreting the Employee Retirement Income Security Act's preemption provision is discussed. Courts have found that medical malpractice was preempted by ERISA, but malpractice claims will continue to be brought, and they will have to make further attempts at figuring out how ERISA applies to this problem.
