Statement of the P.T.O.S. on proposed corporation of the U.S.P.T.O
Article Abstract:
The US Patent and Trademark Office (PTO) would be transformed into a corporation, under H.R. 1659, but it should have direct statutory powers and its CEO or Commissioner subject to oversight by the proposed Advisory Board, according to Patent and Trademark Society (PTOS) testimony on the bill. PTOS recommended imposing constraints on the Commissioner's ability to make appointments, give more authority to the Advisory Board, and eliminate several proposed Title 5 civil service rule exclusions while modifying others. The 200-year-old PTO should not be transferred to the Department of Justice.

Borders and barriers, definitions of authority to do business as a foreign corporation
Article Abstract:
The realities of international and interstate commerce have made traditional standards which regulate companies according to whether they are doing business in a jurisdiction ineffective. Differing federal and state common and statutory law categorizations of activities constituting the doing of business create high transaction costs, burdens, and barriers to commerce. The Model Business Corporation Act's negative definition of what activities do not constitute doing business, is a positive step forward toward consistency and rationality.
