TB hysteria, repeated? As tuberculosis spreads again, lawyers help formulate new battle plans to contain the scourge, made more complicated by the AIDS epidemic
Article Abstract:
The widespread resurgence of tuberculosis combined with the AIDS epidemic have public health officials very worried, but the difference between this and past epidemics is that today lawyers are also involved in the battle, attempting to balance epidemiological concerns with those about protecting victims' civil rights. Most of the extant TB control laws date to the early years of the century and are clearly illegal given current convictions about constitutional rights. Some experts advocate a graduated structure of compulsion to protect public health and ensure that the sick are treated.

Dr. Richard A. Gardner, a forensic psychiatrist with well-known views on child sex abuse, has become a frequent expert witness and media commentator representing the view that the US is in a state of child-abuse hysteria and many of the accusations made are inaccurate. Gardner has developed the diagnosis of Parental Alienation Syndrome (PAS), holding that some mothers afraid of losing custody actively disparage their ex-husbands to their children and indoctrinate them that abuse has occurred. Critics say there is little empirical evidence supporting many of Gardner's theories.

New York TB rules are hailed; even civil libertarians accept new regulations
Article Abstract:
New York City has established new quarantine rules for tuberculosis (TB) patients which accommodate civil rights considerations. The rules are approved by the New York Civil Liberties Union. Carriers of TB could be confined in quarantine for two years, but only if they do not complete medical treatment programs. The new rules are in response to the growing epidemic in the city.
