The McCleskey puzzle: remedying prosecutorial discrimination against black victims in capital sentencing
Article Abstract:
The authors set forth a statistically-based method for determining the existence of race-based prosecutorial discrimination against black murder victims and analyzes possible methods of remedying such discrimination. Issues include an evaluation of the racial implications of the McCleskey v. Kemp death penalty case, and a proposal to commute the death sentences of defendants whose victims' lives have been overvalued based on their race and to award damages to the families of murder victims whose lives have been undervalued on the basis of race.

The exclusionary effects in Microsoft III and IV are analyzed to understand the high-tech sector innovative behavior. The antitrust strategies to decrease the detrimental effects of competition are suggested.
