The 2d Circuit's Southview Farm decision represents a reasonable approach to the regulatory treatment of liquid manure disposal practices of livestock farms
Article Abstract:
The Second Circuit's decision in Southview Farm suggests that storm discharge of stored or spread manure is not covered under the Clean Water Act unless such discharge is in a polluted state while in storage. This is good news for farmers in a sense, but does mean that they will be held accountable under state laws regarding such issues. The case and its implications are discussed in detail.
