The arbitration of discrimination claims in employment cases
Article Abstract:
Title VII of the Civil Rights Act of 1964 gives employees the right to file employment discrimination claims under their collective bargaining agreements and in court at the same time. Employers and unions have attempted through a variety of contractual terms to limit employees' means of relief to one or the other but not both, in order to limit their own liability for discrimination claims. However, limiting employees' means of seeking relief only limits the settlement of such claims instead of aiding their resolution.
