The detrimental health effects of ETS exposure on children in the home
Article Abstract:
Passive smoking has numerous adverse health effects on children, but there are virtually no legal remedies for children exposed in their homes. Constitutional remedies available to prisoners and employees are not available to children, although smoking has been considered in custody and abuse cases. Parents need to be educated as they have been about lead-based paint, and state intervention to protect exposed children should be considered as an acceptable remedy in the future.
