The treaty was not violated
Article Abstract:
The issue in United States v Alvarez-Machain was whether the United States-Mexico extradition treaty constituted an exception to the principle in Ker v Illinois that the way a person is taken before a court cannot keep the court from exerting criminal jurisdiction over this defendant. The extradition treaty cannot be applied to the case of Dr. Alvarez-Machain since it does not make extradition the sole means of exercising jurisdiction. The case was in reality a dispute between the US and Mexico and making foreign policy is the province of the executive and legislative branches.

Mandatory arbitration clauses in general liability insurance policies may prove expensive if they are contradicted by other primary or excess policy provisions
Article Abstract:
General liability insurance for US corporations often incorporates policies or provisions that have contradictory arbitration and service-of-suit clauses and selections of the law to be applied. Thus, companies buying or renewing insurance should consider the complexity and expense of resolving a dispute in a distant or unfamiliar forum, as one factor of the purchase decision. Many insurance companies prefer arbitration in England, Geneva, or NY state.
