Trade secrets in Illinois
Article Abstract:
Illinois law on trade secrets provides protection and injunctive relief, but it is advisable to have employees sign an agreement at the start of their employment to keep information confidential. Under the Illinois Trade Secrets Act and the Restatement of Torts, the plaintiff must show the information is truly secret and the company draws economic worth from its secrecy. The plaintiff must also show that reasonable efforts were made to keep the information secret. The courts recognize that individuals have the right to make use of acquired skills and knowledge.

Doe v. City of Belleville: should the employer differentiate between horseplay and same-sex sexual harassment?
Article Abstract:
The United States Court of Appeals for the 7th Circuit found in Doe v. City of Belleville that suits for same-sex sexual harassment could take place, but that the sexual orientation of harasser and victim were irrelevant. This is the most liberal view of same-sex harassment and was adopted by the 8th Circuit in 1996 and joined by the 7th Circuit this year. Management should treat every case of alleged same-sex sexual harassment seriously. The employer's best interest is to stop any horseplay its employees find offensive, regardless of motivation.

Pepsico v. Redmond: broadening the trade secret concept to encompass corporate strategy
Article Abstract:
The US Court of Appeals for the 7th Circuit ruled that corporate strategy could be a trade secret, despite the negative impact this might have on employee mobility and executive hiring. Courts have in the past expected more from executives in trade secret cases, due due to their influence on strategic decision-making and their potential of generating profit for an employer. That was the reason Redmond was not allowed to disclose any Pepsi trade secrets or confidential information after starting his executive job at Quaker.
