What mediation can & cannot do
Article Abstract:
Disputing parties must understand the mediator's role and their role in order to conduct effective mediation. Mediators do not make decisions. They bring parties together and create an atmosphere in which parties can resolve differences. Labor mediation has been conducted for decades. Parties involved in labor disputes understand the role of mediators and the importance of maintaining relationships. Parties new to mediation must gain such knowledge.

ADR and suspected fraudulent claims
Article Abstract:
Mediation can provide benefits to all parties in suspected fraud cases. Mediation allows a safe environment to communicate information and increases the chance of settlement. The mediator can communicate information privately with each party so neither party feels compromised. Withheld information often stalls the litigation process, increases expense, and provides unfair advantage to one party.

The author discusses factors to consider prior to pursuing mediation to increase the chances of its success, including mediation clauses in contracts, mediator selection, and basic misconceptions regarding mediation.
