The self-policing efforts of the Internet industry are discussed, and have included the Electronic Commerce and Consumer Protection Group. The FTC's Internet Task Force has 'Internet surf days' when privacy claims are reviewed. Many executives have accepted the inevitability of additional privacy regulation.

The difficulty of evaluating confidentiality and attorney-client privilege in the electronic mail medium are discussed. Lawyers should consult with information technology specialists in developing firmwide policies to prevent the inadvertent electronic mail disclosures which can become systemic problems.

Privacy as one of the key issues accompanying the Internet's growth and the need for electronic commerce entities to adopt a proactive stance by developing privacy policies are discussed. Such an approach would raise consumer confidence and allow businesses to take full advantage of e-commerce's and the Internet's economic potential.
