Lost in cyberspace: the digital demise of the first-sale doctrine
Article Abstract:
The first-sale doctrine of copyright law should not apply to Internet transmission of digitized material. The first-sale doctrine allows the buyer of copyrighted material to sell the specific material bought without gaining access to any other copyright rights. Internet technology complicates the way the first-sale doctrine relates to other copyright rights. Congress should propose a rental law in place of the first-sale doctrine for copyright issues relating to digitized material.
