Fair warning: preemption and navigating the Bermuda triangle of E-Sign, UETA, and state digital signature laws
Article Abstract:
The effectiveness of federal and state laws governing the use of digital and electronic signatures in electronic commerce is examined. The effects of preemption of state Uniform Electronic Transactions Acts by the federal Electronic Signatures in Global and National Commerce Act of 2000 are outlined and revisions to the federal Act are proposed.

The author outlines state, federal, and international legislation addressing legal issues in electronic commerce governing electronic signatures. The basic legal issues raised by on-line transactions are addressed, along with varying legislative approaches to electronic signatures, and legislation's role in promoting e-commerce growth.

The liability of certification authorities to relying third parties
Article Abstract:
The responsibilities of certification authorities in the electronic commerce certification process are discussed. Issues include the public key infrastructure, the certification issuance and verification process, problem of unreliable or false certificates, and the liability of CAs for violating certification standards.
