The government's unauthorized seizure of private e-mail warrants more than the Fifth Circuit's slap on the wrist
Article Abstract:
The US Court of Appeals for the Fifth Circuit's decision in Steve Jackson Games, Inc. v. United States Secret Service is based on a misinterpretation of the Electronic Communications Privacy Act (ECPA) and is inconsistent with congressional intent. The court found one wiretap statute inapplicable because the e-mail seized by the Secret Service was not intercepted, but unread stored e-mail can be subject to interception under the ECPA. The court's ruling effectively gives e-mail no privacy protections because it found that interception can only occur when an electronic signal is being transmitted.

Time to pay up: Internet service providers' universal service obligations under the Telecommunications Act of 1996
Article Abstract:
Internet service providers (ISPs) have been exempt from payments of access charges and other contributions to Universal Service since the charges were first imposed in 1983. The convergence of communications and information technologies means that the exemption no longer makes sense and the Federal Communications Commission should terminate it. The old system also invites ways to bypass it and avoid Universal Service-related charges, and this is already occurring with the new Internet phone software. The agency needs a new, unified approach.
