The author discusses the US Supreme Court's decision in Department of the Interior v. Klamath Water Users Protective Ass'n, in which the court ruled that tribal comments to the agency were public records, and the subsequential decision by the Maine Supreme Court in Great Northern Paper, Inc. v. Penobscot Nation, which also requested access to tribal records.
