NLRB gains victories in 'blind box' battles with newspapers

Article Abstract:

The National Labor Relations Board (NLRB) gained legal victories against a California and a Louisiana newspaper that printed blind box job opportunity advertisements. The US 9th Circuit Court of Appeals in San Francisco, CA, ruled the NLRB had subpoena power over the newspaper. In Louisiana, Capital Cities Press agreed to the subpoena before the judge issued a decision. Blind box advertisements do not reveal the employer's name and can be used to discriminate against union members.

Secrecy agreement trumps disclosure

Article Abstract:

The Colorado Supreme Court ruled in Pierce v. St. Vrain Valley School District that a school board promise to an official allegedly guilty of sexual harassment not to reveal why he was asked to leave was a legitimate part of an agreement to entice his resignation, that neither the First Amendment nor the state's Open Records Act could interfere with such an agreement but that the board must then keep the matter confidential.

School board official jailed over records denial

Article Abstract:

The Escambia County Court, a Florida trial court ruling on Florida v. Webb, jailed a school board official for refusal to honor the open records request of a parent who had criticized her. Florida is a state with a strong sunshine law and this case belied criticism of open records laws for ineffectiveness because government officials who refused to honor them were not penalized.
