Nevada judge labels newspaper "garbage."(Courts View Newspaper Delivery as Littering)
Article Abstract:
A Nevada district court found that the Sparks city ordinance that was used to prosecute the 'Daily Sparks Tribune' for littering the lawn of Donald Glock was overbroad and therefore not constitutional as applied to the newspaper. The city had argued that the restriction on distribution of the newspaper was not content-based and noted that the promotional distribution was commercial speech. The newspaper stated that the ordinance was vague and overbroad because almost anything could be characterized as litter and enforcement could have a chilling effect.

Amtrak subject to First Amendment scrutiny: government ties make rail service a state actor
Article Abstract:
The US Supreme Court ruled in Lebron v. National Railroad Passenger Corp. that Amtrak is a government entity that is a state actor under civil rights and constitutional laws. Amtrak refused to display a billboard that parodied Coors beer ads and was critical of Coors support of political causes. The trial court found for Lebron, but the appellate court reversed, finding that the statute that created Amtrak stated it was not a government entity. The Supreme Court reversed because of the US government's extensive involvement in and funding of Amtrak.
