Public university must release records to professors' group
Article Abstract:
The New Jersey Supreme Court ruled in Keddie v. Rutgers that the university was required to disclose certain records under common law public access rights. The Court agreed with the lower courts that the records at issue, which included attorney billing records and legal submissions, were not public records that must be disclosed under the state's Right-to-Know Law. Under the common-law public records definition, the public interest in disclosure for the legal submissions outweighed nondisclosure concerns. The Court remanded to the trial court on other records.

State insurance regulator ordered to release merger records
Article Abstract:
The Ohio Supreme Court ruled in Ohio ex rel. The Plain Dealer v. State Department of Insurance that the State Department of Insurance improperly withheld records regarding the proposed sale of Blue Cross and Blue Shield of Ohio to Columbia/HCA Healthcare Corp. The sale failed to occur because the Department concluded the terms of the sale were unfair to the public and to policyholders. A reporter for The (Cleveland) Plain Dealer requested access to the records but was denied.
