Two opposing views on whether schools should be allowed to randomly test athletes for drug use are presented. U.S. Supreme Court Justice Antonin Scalia, writing for the majority opinion that allowed testing, asserted that fourth amendment rights are different in public schools because these athletes have less expectation of privacy and expose themselves to regulation by joining the team. A sports writer said that testing of a few athletes will not prevent drug use, and it is a violation of privacy and unreasonable search.

Growing information about the adverse health affects of secondhand smoke have led some people to call for as ban on smoking in the workplace. They claim that there is no excuse not to protect non-smokers from air pollution in the workplace. Opponents of such a ban claim that improving air filtration systems and establishing smoking areas in the workplace can protect non-smokers from secondhand smoke.
