Who decides how to serve native load?

Federal Energy Regulatory Commission proposes to use a new test to determine whether an entity has market power and if it should be allowed to charge market based rates. The accurate analysis is very important and the commission must implement a fair market power test that respects state commission decisions about serving native load.
