Dworkin and Casey on abortion
Article Abstract:
An examination of abortion rights in relation to Ronald Dworkin's views and the 1992 Supreme Court verdict in Planned Parenthood v. Casey suggests that in each case the full implications of the arguments have not been considered. Dworkin suggests that abortion is a religious issue and thus the state should not be allowed to prohibit it. However, this argument makes it difficult to justify any level of state intervention in abortion. Similarly the undue burden test outlined in the Casey decision is flawed, in that its formulation conflicts with the reasons cited to justify it. The test as stated wrongly allows small obstacles to be placed in the way of abortion.

Article Abstract:
Laws that make abortions difficult to access have the positive effect of diminishing the number of abortion cases. National statistics show that abortion is mostly resorted to by women who want to terminate an unwanted pregnancy rather than as a measure to save the lives of at-risk pregnant women. In effect, abortion is chosen as a birth control device despite the availability of varied contraceptives. This trend is being reversed in Mississipi through the implementation of requirements such as parental consent for minors and 24-hour waiting periods.

Afro-American representation in the law is necessary to further the advancement of the black community. This holds true for all minority groups as well. Although the practice of law provides black Americans with numerous professional and financial opportunities, prejudice still exists within the legal field. Aspiring lawyers should prepare themselves academically for the rigors of studying law. They should also enroll in the best possible law school.
